November 18, 2010 – The ACLU of Oregon has urged the Portland City Council to oppose the creation of new exclusion zones for those found guilty of gun-related offenses. ACLU has consistently voiced objection to the use of civil exclusion zones as an end-run around fundamental due process protections provided in criminal court. Instead of bringing back exclusion zones in Portland, the ACLU urged the Council to cooperate with the District Attorney to urges judges to apply appropriate orders as a condition of probation. Pursuing exclusions in criminal court would guarantee that defendants would be represented by counsel and would understand the variances available.
